Terms of Service

These Terms of Service ("Terms") govern your access to and use of IWS Console, operated by 3Bits Mind. By using IWS Console, you agree to these Terms. If you do not agree, you must not use the platform.

1. Your Account

You must create an account to use IWS Console. You are responsible for:

  • Keeping your credentials secure and not sharing access with unauthorised parties
  • All activity that occurs under your account
  • Providing accurate registration information

We reserve the right to suspend or terminate accounts that violate these Terms.

2. Acceptable Use

You agree not to use IWS Console to:

  • Distribute malware, spam, or other harmful software
  • Launch DDoS attacks, port scanning, or other network abuse
  • Host illegal content or content that violates applicable laws
  • Violate the rights of third parties, including intellectual property rights
  • Attempt to gain unauthorised access to our systems or other users' data

Violation of this section may result in immediate account suspension without refund.

3. Billing and Payment

Regarding billing, you agree to:

  • Pay all fees incurred by your account at the end of each billing cycle
  • Provide accurate payment information
  • Monitor your spending using the spending limit feature to avoid unexpected charges

We reserve the right to suspend services if payment is not received within 14 days of invoice date.

4. Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for downtime caused by:

  • Scheduled maintenance (announced in advance)
  • Third-party service failures (Cloudflare, data centre providers)
  • Force majeure events
  • Actions caused by users violating these Terms

5. Data and Content

You retain ownership of all data and content you deploy on IWS Console. You grant us a limited licence to host and process your content solely to provide the platform services. We do not access your project files or databases except for support purposes with your explicit permission.

6. Termination

You may delete your account at any time from the console. Upon termination:

  • All server instances and projects will be deleted
  • Any outstanding invoices remain due
  • Data is deleted within 30 days

7. Limitation of Liability

To the maximum extent permitted by law, 3Bits Mind is not liable for indirect, incidental, or consequential damages arising from your use of IWS Console. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

8. Changes to Terms

We may update these Terms from time to time. We will provide at least 14 days' notice of significant changes via email. Continued use of IWS Console after changes take effect constitutes acceptance.

9. Governing Law

These Terms are governed by the laws of Bangladesh. Any disputes shall be resolved in the courts of Khulna, Bangladesh.
